Panduan AJB Hingga SHM beserta Syarat, Biaya, dan Prosesnya

AJB Hingga SHM tergolong penting Untuk pemilik tanah Sebab AJB bukan merupakan bukti kepemilikan hak atas tanah, melainkan dokumen yang membuktikan telah terjadi transaksi jual beli tanah.

Sertifikat Hak Milik (SHM) dan Akta Jual Beli (AJB) merupakan dua jenis dokumen legalitas properti. 

Kedua dokumen tersebut bisa dibilang saling Yang Terkait Bersama dan Memiliki fungsi yang krusial Untuk transaksi jual beli properti. 

Apakah Perlu AJB Hingga SHM?

AJB adalah dokumen yang Mengungkapkan telah terjadinya peralihan hak kepemilikan atas Tempattinggal dan/atau tanah Lewat jual beli. 

AJB dibuat dan diterbitkan Dari Pejabat Pembuat Akta Tanah (PPAT) Supaya tidak tergolong sebagai bukti kepemilikan properti. 

Pasalnya, bukti autentik mengenai hak kepemilikan properti adalah sertifikat, sebagaimana dijelaskan Untuk Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA). 

Sambil Itu, AJB adalah bukti Untuk peristiwa perdata berupa jual beli Pada tanah atau Tempattinggal, sedangkan SHM adalah bukti kepemilikan Pada tanah atau Tempattinggal tersebut.

Nah, Sebagai memastikan kepemilikan atas properti yang Mutakhir dibeli tercatat secara resmi, pembeli perlu melakukan proses balik nama sertifikat menggunakan AJB sebagai salah satu dokumen persyaratan.

Apa Syarat Mengubah AJB Hingga SHM?

Di prosesnya, cara mengubah AJB Hingga SHM memerlukan sejumlah dokumen persyaratan yang harus dipenuhi, meliputi: 

• Menyertakan AJB

Bagaimana Cara Mengurus AJB Hingga SHM?

1. Mengajukan Permohonan Sertifikat Hingga PPAT

Hal pertama yang harus dilakukan adalah mendatangi PPAT setempat.

Langkah ini didasari Di Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah.

Di Pasal 37, disebutkan bahwa setiap pengurusan balik nama sertifikat tanah harus Lewat PPAT.

Untuk proses ini, PPAT Akansegera memeriksa kesesuaian data yuridis dan data teknis sertifikat tanah pemilik lama Di BPN.

Khusus Sebagai penjual tanah, dibutuhkan syarat lain seperti bukti pembayaran Organisasi Internasional (Iuran Wajib Bumi dan Bangunan).

Di Samping Itu, perlu dilampirkan pula sertifikat tanah dan surat pernyataan Untuk penjual, yang Mengungkapkan bahwa tanah tersebut tidak Untuk keadaan sengketa.

2. Pengukuran Hingga Lokasi

Setelahnya semua berkas lengkap dan pemohon Menyambut tanda terima dokumen Untuk kantor pertanahan, petugas BPN Akansegera melakukan pengukuran Hingga lokasi tanah.

Pengukuran dilakukan Dari petugas Bersama cara ditunjukkan batas-batas Dari pemohon atau kuasanya.

3. Pengesahan Surat Ukur

Hasil Untuk pengukuran bidang tanah tersebut Akansegera didokumentasikan dan dipetakan Di Badan Pertanahan Nasional.

Lanjutnya, surat ukur Akansegera disahkan atau ditandatangani Dari pejabat yang berwenang.

4. Studi Dari Petugas Panitia A

Lanjutnya,  dilakukan Studi Untuk Panitia A yang dilakukan Di Sub-Seksi Pemberian Hak Tanah.

Anggota Panitia A sendiri terdiri Untuk petugas BPN dan lurah setempat.

5. Pengumuman Data Yuridis Di Kelurahan dan BPN

Setelahnya dilakukan Studi Dari Panitia A, petugas BPN Akansegera memajang data yuridis permohonan hak tanah Di kantor kelurahan dan BPN Di 60 hari.

Tujuannya Sebagai menjamin tidak ada klaim atau keberatan Yang Terkait Bersama permohonan hak atas tanah tersebut Untuk pihak lain.

6. Terbitnya SK Hak Atas Tanah

Lanjutnya, tanah yang Sebelumnya berstatus girik tersebut Akansegera terbit Untuk bentuk Sertifikat Hak Milik (SHM).

7. Pembayaran Bea Perolehan Hak atas Tanah (BPHTB)

BPHTB dibayar sesuai luas tanah yang dimohonkan.

Jumlahnya mengacu Untuk Nilai Jual Objek Iuran Wajib (NJOP) dan luas tanah.

Pembayaran BPHTB Mutakhir bisa dilakukan Di Di surat ukur telah selesai dibuat.

8. Pendaftaran SK Hak Sebagai Penerbitan Sertifikat

SK Hak Setelahnya Itu dilanjutkan prosesnya Bersama penerbitan sertifikat Di subseksi Pendaftaran Hak dan Informasi (PHI).

9. Pengambilan Sertifikat Di Badan Pertanahan Nasional

Ada beberapa biaya AJB Hingga SHM Di Kantor BPN, salah satunya biaya pengecekan keabsahan sertifikat tanah senilai Rp50.000.

Di Samping Itu, ada pula biaya pelayanan balik nama sertifikat yang besarannya dapat dihitung menggunakan rumus berikut ini:

• Nilai tanah (per meter persegi) x luas tanah (meter persegi) : 1.000

Misalnya, Anda membeli tanah Sebagai membangun Tempattinggal seluas 100 m² Bersama harga Rp1 juta per 2, maka perhitungannya adalah sebagai berikut:

• Rp1.000.000 x 100 meter persegi : 1.000 = Rp100.000

Karena Itu, total biaya pengecekan keabsahan sertifikat tanah dan biaya pelayanan balik nama sertifikat Di Kantor BPN adalah Rp150.000.
